This Privacy Policy—United States describes how MANGO-NY and its parent affiliate company, PUNTO FA, S.L., individually and collectively doing business as MANGO (“we,” “us,” “our”), collects, uses, and shares personal data about people who visit us (“you,” “your”) online at shop.mango.com/us and other MANGO websites and mobile applications (“MANGO App”) where this Privacy Policy is posted (collectively, “Sites”), shop in person at our stores in the United States (“Stores”), or communicate with us in other ways and your choices and rights regarding your personal data.

Please review this Privacy Policy carefully. By visiting our Sites or Stores or communicating with us in other ways, you are agreeing to the collection, use and processing of your personal data as described in this Privacy Policy. What is personal data and how does Mango collect it?

We use the term “personal data” in this Privacy Policy to refer to information in any form that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer.

MANGO collects personal data that you submit to us, is collected online using cookies and similar internet technologies, when you visit our Sites, and when you communicate with us in other ways. We also may receive personal data from social media, marketing resources, and other third parties.

We collect personal data, for example, when you:

  • Visit any of our Sites including any website, online portal, or mobile app we operate that displays a link to this Privacy Policy
  • Set up an account with MANGO
  • Purchase our products or use our services online or at a MANGO Store
  • Contact customer support or send us a question
  • Sign up for our newsletters or marketing and promotional emails
  • Use the chat feature on our Sites
  • Participate in our loyalty programs such as MANGO Likes You
  • Participate in events such as our live shopping events
  • Receive a gift or gift card purchased for you by a friend or family member
  • Post or comment about MANGO online or on social media
  • Communicate or interact with us in other ways.

This Privacy Policy does not apply to:

Collection by third party websites. Our Sites may contain links to social media and third-party websites that we do not operate or control. These may include, for example, credit/debit processors and installment sales providers. The information practices and the content of these third-party sites are governed by their own privacy practices. We encourage you to review the privacy statements posted by third-party websites to understand how they will manage your information.

Anonymized or aggregated information. Information that has been modified in a substantial way so that it no longer can reasonably identify or be linked to an individual.

Employment and business communications. Information we obtain about our employees, job applicants, and other personnel and the employees and representatives of business customers, service providers, suppliers, and business partners (except as explained in the section titled Notice for California Residents: your California Privacy Rights).

What personal data does Mango collect?

Below are the categories of personal data collected by or on behalf of MANGO in the preceding twelve months and examples of the types of data, including personal data, within each category.

Identifying information. We will ask for the following direct identifying information when you:

  • Sign up to receive our newsletter: e-mail address
  • Register for an online MANGO account: name, e-mail address, password you set up, and mobile phone number
  • Join a loyalty program: name, e-mail address and mobile phone number, and password.

Online identifiers. When you visit our Sites, we automatically collect the online identifiers for the device you are using, including the IP address, mobile device identifier, and advertising identifier.

Contact information. We request a postal address for shipments and your e-mail address and telephone number for online order confirmations and other transaction and marketing communications.

Payment information for purchases. When you place an order online, we will ask for your name, e-mail address, phone number, payment card number and other details, contact preferences, and shipping information. Your payment will be processed using a system certified under the Payment Card Industry-Data Security Standards (PCI-DSS), which may be operated either by MANGO or by a third-party payment processor. If a third-party processor is used, you will be transferred to the processor’s website to provide your card information. MANGO stores the expiration date and postal code associated with your payment card but does not store your full payment card number or the CVV number. Instead, we use a service provider to create a token we can store that represents your card’s primary account number. If you choose to pay using a payment service such as PayPal or an installment service such as Klarna or Afterpay, the third-party service may require your name, email address, payment card, and other information. The service partner may provide some non-financial information to us. In-store purchases using a credit or debit card are processed by third-party payment processing service and MANGO does not collect token or other information.

Transaction history. Your MANGO account contains your transaction history including products you selected, your purchases, clothing sizes, loyalty rewards you earned, installment purchases, and other account information.

Internet activity. We automatically collect information when you visit our Sites, logon to your online account, interact with MANGO content on a third-party site or app, or interact with an email from MANGO. For example, we may collect your browser and device type, internet browsing and search history, frequency, and duration of visits to our Sites and your browsing session, the pages you visited on our Sites, the website you came from and the website you go when leaving our Sites. Geolocation data: With your consent, we may show you the nearest MANGO stores using your specific mobile device location if enabled on your device or your approximate location based on your IP address when using a computer. You can also enter an address, zip code, or place name to get information about MANGO store locations.

Video data: We may use video monitoring services in our Stores for security purposes.

Information used to profile and make inferences about your preferences and interests. We may draw inferences about your preferences and interests from the data we collect from various sources such as your transaction history, browsing activity on our Sites, and frequency of your visits to MANGO Sites and Stores.

How does mango use personal data?

We use personal data to conduct our business, stay in contact with our customers, and provide products and services to meet their interests and expectations, including to:

  • Create an effective and engaging shopping experience online at the MANGO Sites and in person at our brick-and-mortar Stores
  • Set up and manage your MANGO online account and be able to identify and authenticate your membership when you visit our Sites and Stores
  • Process your online and in-Store purchases, including payment transactions
  • Confirm your purchases by e-mail or other channels, such as text messages
  • Use fraud detection and prevention measures to protect online and mobile app purchases
  • Communicate with you about orders, shipping, deliveries, delays, returns, questions, requests, and refunds
  • Provide customer service and support
  • Process installment purchases through a third-party processor
  • Administer MANGO Likes You and other loyalty programs
  • Remind you about items left in your shopping cart that you have not purchased
  • Profile your interests and preferences so we can send personalized communications such as newsletters, information about products and services, features, surveys, offers, promotions, contests, and events. You can tell us to stop sending marketing communications as explained under “your choices for e-mail and marketing communications.”)
  • Deliver targeted digital advertising on our Sites, social media platforms, and third-party websites, and evaluate the effectiveness of our online marketing (see our Cookie Policy)
  • Operate, maintain, improve, and promote the MANGO Sites and Stores
  • Measure and evaluate how visitors use our Sites and enable us to save your preferences and other information
  • Send “back in stock” notices with your consent
  • Process and deliver contest or sweepstakes entries and rewards
  • Protect and secure our Sites, Stores, and customers by investigating suspicious activity
  • Comply with valid legal process and respond to governmental requests.

When and to whome does Mango disclose personal data?

Personal data collected by MANGO is disclosed or accessible to data processors and independent third-party services who assist or partner with us in conducting our business and commercial activities, for safety and security purposes, and as required to comply with applicable laws. MANGO does not sell your personal data for monetary consideration.

Third-Party Service Providers: Third parties may have access to or process your personal data for the purpose of providing business services for us, such as: processing payments; fulfilling and shipping orders; hosting, maintaining, and securing our Sites and Site features; conducting e-mail and other marketing programs; and providing IT technical support including systems management, data backup, and storage. We do not permit our third-party service providers to use the personal data that we make available to them for their own commercial purposes.

Online Technical and Analytics Services:  We use Google Analytics and other authorized third-party services to measure and evaluate access to and traffic on our Sites, identify a user’s language and other preferences, authenticate a user when logging in to the user’s account, and identify ways to improve our Sites’ performance and functionality. These third-party services operate independently from us and have their own privacy policies, which you should review before providing your personal data. (See, for example, Google Analytics-Data privacy and security.) See our Cookie Policy for information about choices you can make about how we collect and use data when you visit our Sites.

Digital Advertising Services. We may use digital advertising techniques to show you personalized content on our Sites and to show MANGO ads when you visit social media platforms and third-party websites. We may authorize digital advertising services such as social media, advertising networks, and search engines to place cookies, pixels, and similar technologies on our Sites to track your usage of our Sites and other internet sites. These services operate as independent data controllers with respect to the collection and use of your personal data and have their own privacy policies and practices for the collection and use of personal data. We also may share your e-mail address or device ID on a secure basis with the advertising services, which they use to display MANGO banners and ads to you when you visit third-party sites and measure how many people click on our ads. See our Cookie Policy for more information about cookies and how you can restrict the types of personalized advertising that involve tracking your internet activity in a way that identifies you.

Affiliates. We may share information, including personal data, with companies that share common corporate ownership with MANGO, and they may use that information for purposes that are consistent with those described in this Privacy Policy.

With Your Consent. We may share personal data with third parties when we have your consent to do so.

Security and Protection. We may disclose personal data or other information that we believe is appropriate or necessary to (1) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (2) comply with applicable laws and regulations, (3) investigate and defend against claims or allegations and enforce our contracts, (4) protect the security or integrity of our Sites and the systems used to operate the Sites, (5) protect our Stores, property, and legal rights and the property, rights, and safety of others.

Law Enforcement, Legal Process and Compliance. We may disclose personal data or other information if required to do so by law or when we reasonably believe such action is necessary to comply with applicable laws, in response to a facially valid court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.

Business Transaction Parties. We reserve the right to disclose or transfer your personal data, subject to appropriate confidentiality safeguards, in connection with a business transaction such as a financing, reorganization, merger, or sale of a business.

How does Mango protect personal data?

We maintain commercially reasonable security measures appropriate to the nature of the personal data we collect. However, neither people nor systems can operate in a fully secure manner and no method of transmission over the internet or storage of electronic data is fully secure. While we use commercially reasonable efforts to protect your personal data, we cannot guarantee the security of the personal data you provide to us.

Our Sites permit you to create an account protected by a password you create. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else who has obtained your password from you, even if that person was not authorized by you. You should notify us of any unauthorized use of your password or account, and, if any unauthorized use is suspected, you should immediately reset your password. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us of the problem.

All purchase transactions made on our Sites are processed using secure payment systems operated either by MANGO or third-party payment processors. Confidential payment details are transmitted directly in encrypted format (SSL). We and our payment processors manage your credit card information in accordance with the Payment Card Industry Data Security Standards.

Important reminder: You should never provide your credit or payment card details in an e-mail or on social media.

How long does Mango keep personal data?

We will retain your personal data for as long as we are continuing to communicate or provide services to you and as reasonably necessary to carry out the purposes outlined in this Privacy Policy, comply with our legal obligations, enforce agreements, and resolve any disputes. To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements. 

In some circumstances we will anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

What if I am not of legal age?

The MANGO Sites are directed to users who are of legal age in the state in which they live (often, but not always, age 18). In addition, MANGO does not knowingly collect personal data about children under the age of sixteen (16) years without consent from a parent or legal guardian. If you have reason to believe that we have obtained personal data about a child under age 16 without the appropriate consent, please contact us as explained in “How to Contact Us” and we will investigate and delete the information.

Your choices for e-mail and marketing communications

E-mail marketing. You can opt-out of receiving marketing communications from us by following the “unsubscribe” instructions included in each of our e-mail marketing communications, and we will process your request to unsubscribe within ten business days after receiving it. You can also opt-out by emailing us at personaldata@mango.com and providing the names/email address that you want us to remove you from our marketing database and add you to our ‘Do Not Contact’ list. If you opt-out of marketing messages, we may still send e-mails to you that involve your orders or responses to your questions.

Text messages. If you previously gave us permission to send recurring automated promotional and personalized marketing communications to you by text message, you can withdraw that consent at any time by replying following the directions provided in the text message you received. It may take up to seven days to process your request to STOP text marketing messages.

How to manage your account and subscription preferences

If you have a MANGO online account, you can update, correct, delete, or change your account information, preferences and subscriptions and consents to receive newsletters, emails, and other marketing communications, and by logging into your account from any of our Sites. If you do not have a MANGO account, please contact us as explained in “How to Contact Us.”

Loyalty, sign-up and other incentive programs,

MANGO offers loyalty programs, benefits, and account sign-up discounts for our customers in various locations. Examples of the programs we offer include the following.

The MANGO Likes You. In jurisdictions where available, MANGO Likes You is a loyalty reward program for all customers when they register an online MANGO account, by providing their name, e-mail address, mobile phone number, and a password. It is also available to customers who sign up for the program in-Store by providing their name, e-mail address, and mobile phone number. Participants accumulate points, called “Likes,” when they purchase MANGO products or take actions such as recycling MANGO products or picking up online purchases in-Store. Members also may receive information about new products, sales, and promotions. If you choose to submit your date of birth, you will receive extra Likes as our birthday gift to you. No purchase is required to participate. You can read the detailed terms of the MANGO Likes You program on our Sites to find out how to earn Likes, use your Likes to make purchases, when they expire, and other information about the program.

Newsletter Subscription. We may also offer a discount off the next purchase to customers who subscribe to our e-mail newsletter by providing their e-mail address. We use your e-mail address to send newsletters, special offers and other promotional messages. Your information may be shared with our email and advertising providers. You may unsubscribe from our newsletters and other marketing emails using the “unsubscribe” link in each e-mail or contact us.

The purpose for offering loyalty program benefits to our customers includes expanding our direct marketing outreach, enhancing our customers’ shopping experience, and encouraging repeat business. Because these benefits involve some of personal data, they may be considered to offer a financial incentive or price or service difference under California and other states’ privacy laws. For our MANGO online account holders, we do not request any additional personal data to be enrolled in MANGO Likes You. In situations where additional personal data is requested (such mobile phone number for in-Store enrollment) or birth date to receive an incentive reward, we believe the program benefits are reasonably related to the value to us of the personal data requested and the costs we incur in providing the program. What are my rights concerning my personal data?

Your Privacy Rights. MANGO respects your privacy concerns and legal rights regarding your personal data. We will process your request to exercise the following privacy protections even if you do not live in a place where these are required by law.

The right to know—the right to know what personal data we have about you and request copies of your personal data collected about you.

The right to correction—the right to request that we correct or update any information you believe is inaccurate or has changed.

The right to opt-out of targeted advertising—the right to direct MANGO not to collect or use your personal data for advertising that is based on personal data obtained on our Sites or by third-party ad partners based on your activities over time and across nonaffiliated websites or online applications to predict your preferences or interests.

The right to deletion—the right to request that we delete your personal data, subject to legally permitted reasons for which we may decline your request in part or in whole.

The right to data portability—the right to request that provide a copy of the digital data we have collected about you to your or another organization as you direct, subject to legally permitted conditions.

The right to withdraw consent—the right to revoke your consent previously granted to any collection, use, or sharing of personal data for which we requested, and you provided, your affirmative consent.

Depending on your state of residence, you may have additional legal rights with respect to your personal data that we will follow to the extent applicable to our operations. For example, some states may require a specific procedure for consumers to appeal from the denial of all or part of a consumer’s request to exercise certain right.

International data transfers

The personal data collected on our MANGO USA Sites and from customers in our Stores in the United States may be processed in the United States, Canada, Spain, and other countries of the European Economic Area in accordance with applicable laws and the guidelines of this Privacy Policy. The MANGO USA companies and Sites follow the information and consumer protection laws of the United States and its individual states. If you reside or are located in a different country, the data protection laws of that country may differ as to how your personal data is protected. We want you to understand that when you provide your personal information to us, or we obtain your information through MANGO USA Sites or other communications with us, you are giving us your express consent to transferring your personal information to, and processing your personal information in, the United States, subject to U.S. laws and the terms of this Privacy Policy.

Changes to this Privacy Policy

We reserve the right to amend this Privacy Policy at any time in order to address future developments MANGO’s business, changes in industry trends, or changes in legal requirements. If we materially alter the terms of this Privacy Policy, we will post the revised Privacy Policy on our Sites and provide other notification as may be required by applicable law.

Any changes will become effective upon the posting of the revised Privacy Policy on the Sites. You can determine when the Privacy Policy was last revised by referring to the “Last Updated” legend on the top of this Privacy Policy.By continuing to use the Sites following such changes, you will be deemed to have agreed to such changes. Notice at collection for California residents: Your California Privacy Rights

If you are a California resident, this section of our Privacy Policy describes your rights under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (together, the “CCPA”). This section applies only to personal data about California residents and their households, including representatives of companies doing business with MANGO.

Categories, sources, purposes, and sharing of personal data. Right to know. You can request to know the following about your personal data we have collected about you, and we will provide the following with respect to the preceding 12 months:

  • The categories of your personal data we collected;
  • The categories of sources from which your personal data was collected;
  • The business or commercial purpose for which personal data was collected;
  • The categories of third parties with whom we shared personal data;
  • If a business sells personal data, the business must identify the categories of personal data sold and the categories of third parties to whom each category of personal data was sold (MANGO does not sell personal data for monetary consideration and consumers can restrict the collection and use of personal data for targeted advertising as described in our Cookie Policy);
  • The categories of personal data we disclosed for a business purpose, and for each category identified, the categories of third parties to whom we disclosed that particular category of personal data; and
  • Specific pieces of personal data collected about you and that is reasonably searchable or accessible (except for sensitive personal data, which we will describe but not transmit).

Right to request changes or corrections. You can ask us to correct or update personal data we have about you, and we may consider relevant circumstances to confirm the accuracy of the changes you request such as:

  • The nature of the personal data;
  • How we obtained the information originally; and
  • Appropriate documentation supporting the change.

If you have an account with us, you can directly update or correct some of the personal data in your account by logging onto your account. If you do not have an account with us, please see “How to submit a California consumer request” to learn how to submit a request to us to correct your inaccurate personal data.

Right to request deletion. You have the right to request that we delete personal data which we have about you, subject to specific exceptions permitted by law. We are not required to delete personal data if it is necessary to complete a transaction, we continue to use it for a business purpose compatible with the context in which you provided the information, or we are required by law to retain to retain the information.

If you submit a request to delete personal data, we will confirm receipt of your request within ten (10) days and follow appropriate procedures to verify the identity and authority of the person submitting the request. If your request is verified, we will delete or fully de-identify (and direct our service providers and contractors to delete or de-identify) all or part of the requested personal data from our (and their) records, unless an exclusion applies. If we are unable to fulfill all or part of your request, we will let you know why (for example, if we have a permitted reason to retain certain information or if the identity of the requesting person cannot be verified). For technical reasons and to maintain anonymous business statistics, we may anonymize or aggregate personal data rather than erase it completely from our systems.

Right of non-discrimination for the exercise of your privacy rights. You have the right not to receive discriminatory treatment or retaliation for the exercise of the privacy rights conferred by the CCPA. MANGO respects your privacy rights and will not discriminate against you if you exercise any of your rights.

Right to opt-out of sharing personal data for targeted advertising. You have the right to direct us (opt-out) not to collect or share your personal data with third parties for the purpose of showing you targeted advertising based on data collected from your browsing activity on our Sites and other websites as collected by digital advertising companies. How we verify a consumer request. We are required to verify the identity any person submitting a request to know, correct, or delete personal data. If you make a request on behalf of someone else, we will need to verify your authority to make that request and may require confirmation signed by the consumer. We use methods of verification specified in the CCPA regulations such as matching information we have on file for you, such as your full name, email and postal address, phone number, and transaction history. We reserve the right to deny a consumer request if the identity or authority of the requesting party cannot be confirmed.

How we respond to consumer requests. We will confirm receipt of your consumer request within ten (10) business days and may request additional information necessary to verify that you are authorized to make the request. We will respond to any verifiable consumer request within forty-five (45) calendar days of receiving it, subject to delays and exceptions permitted by law. If we require more time to respond, we will let you know the reason and the extension period in writing.

We will respond to your request by using the email address or U.S. Postal address you provided to us when making the request. If your request relates to personal data we have collected about you, we will provide information collected or Stored during the 12-month period before receiving your verifiable request. We do not accept or respond to requests to exercise rights sent by postal mail.

If we cannot comply with all or part of your request, we will explain the reasons why. For data portability requests, we will select a format to provide your personal data that is readily useable and should allow you to transmit the information readily from one entity to another entity.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We will not discriminate against you if you make a request about your personal data.

As explained in the section of our Privacy Policy titled “Loyalty programs,” customers who open an online account with MANGO are automatically enrolled in our MANGO Likes You loyalty program where available and no additional personal information is required. Customers may enroll in the program in-Store where available by providing their name, e-mail address, and mobile phone number. Additional incentives may be offered to customers who submit other personal data such as their birth date.  By opening a MANGO online account or enrolling in-Store in the MANGO Likes You program, customers may receive a more favorable price or rate for products and services than is available to customers who do not participate in the programs. Please see the Terms and Conditions on our Sites for details about the current loyalty programs available where you reside.

Under the CCPA, differences in price or rate for loyalty program participants are not discriminatory and permitted if they are reasonably related to the value of the personal data collected by choosing to participate the loyalty program. We estimate that value or personal data collected via a loyalty program by taking into account the anticipated revenues from enhanced sales of products incentivized by the program and the expenses we incur in providing the program. Those expenses may include, for example, the cost of discounting purchases made by program participants, managing, and operating the program, and offering free shipping on some purchases. Based on that estimate, we believe in good faith that the price or rate differences offered through our programs are reasonably related to the value of the participants’ data.

California rights under “shine the light” law. California residents may request a list of the types of customer information we provided to third parties for their direct marketing purposes and the names and addresses of all third parties with which we have shared such information during the past calendar year. We will provide the information to you free of charge within 30 days of your request. You can request this information by emailing personaldata@mango.com. Within thirty (30) days of receiving your request, we will provide you with the information at the address you designate in your request, which may be an email address or postal address.
